1. Acceptance

Use of the platform constitutes acceptance of these Terms and the Privacy Policy.

2. Eligibility

• Must be legally able to form a binding contract.
• Not located in a restricted/sanctioned jurisdiction.
• Use only wallets you control.

3. Wallet & On-Chain Accounts

You connect a Solana wallet. You are solely responsible for key security. We never request seed phrases and cannot recover lost keys. An on-chain program account (PDA) must exist before deposits.

4. Deposits & Withdrawals

Final on confirmation. A small buffer may be required for fees; “Max” reflects this. Verify stuck or failed transactions on-chain.

5. Tournaments

Entry fees, timing, and eligibility may vary. Prize pool shown excludes treasury allocation (currently 20% of entry fees). We may adjust or cancel for abuse, faults, or compliance reasons.

6. Prize Distribution

Default: 1st 60%, 2nd 30%, 3rd 10% of displayed prize pool unless otherwise stated. Minor residual lamports may occur.

7. Referral Program

Rewards follow published percentages. Self-referrals, Sybil activity, wash behavior, or spoofing may void rewards. Codes may be revoked.

8. Fees

Treasury allocation (currently 20% of entry fees) plus Solana network fees. Future fees may be introduced with notice.

9. User Content & Profile

Usernames and images must not be infringing, abusive, or illegal. We may modify or remove content.

10. Leaderboards & Transparency

Ranks, usernames (or address abbreviations), earnings and stats are public by participation.

11. Prohibited Conduct

• Unapproved bots / automation.
• Manipulation (collusion, wash trades, Sybil wallets).
• Security interference or malicious code.
• Reverse engineering beyond fair use.
• Ban or region‑restriction evasion.

12. Data & Privacy

Limited off-chain metadata plus immutable on-chain data. See Privacy Policy for details.

13. Market & Price Information

Data may be delayed, derived, or estimated. No guarantee of accuracy or suitability.

14. No Custody / Non-Custodial Notice

We do not control private keys. Actions you sign are executed by your wallet.

15. Risk Disclosure

Digital assets carry risk including total loss. Smart contract bugs, network issues, forks, regulatory shifts, or third‑party outages may impact use.

16. Disclaimer of Warranties

Service provided “AS IS” and “AS AVAILABLE” without warranties of any kind.

17. Limitation of Liability

No indirect or consequential damages. Aggregate liability limited to the greater of USD $50 or total platform fees (excluding entry fees/prizes) paid in prior 3 months; subject to applicable law.

18. Indemnification

You indemnify and hold harmless Pulse and its personnel from claims arising out of your use, violations, or infringement.

19. Suspension / Termination

Access may be suspended or terminated for violations, fraud suspicion, legal, security, or operational risk. On-chain assets remain in your wallet.

20. Changes

Terms may change prospectively. Continued use after effective date is acceptance. Material changes may be announced.

21. Third-Party Services

External links or integrations are at your own risk and governed by their terms.

22. Compliance & Law Enforcement

We may disclose data when legally required. You are responsible for tax reporting.

23. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States (without regard to conflict of law principles). Any disputes will be brought exclusively in the state or federal courts located in the United States with appropriate jurisdiction. We each submit to those courts’ personal jurisdiction. No arbitration clause applies.

24. Severability & Waiver

If a provision is unenforceable, others remain. Failure to enforce is not a waiver.

25. Entire Agreement

These Terms plus referenced policies form the entire agreement.
